Title: FOIA/ Policy Analyst
Duties:
- Coordinate with FOIA Officers in other organizations on FOIA matters to include request, appeals and litigation, keeping abreast of the status of recent developments in the field of public disclosure including recent court and departmental decisions and current legislative activities and performing other duties as assigned
- Weekly and Monthly reporting to CVM FOIA staff on all phases of processing requests
- Assist in coordination prep and process of legal briefs

- Conduct legal research and analysis of each FOIA requested
- Analyze FOIA responses for adequacy of search, overall content, and proper administrative forms.
- Generate FOIA request acknowledgement letters using standard template letters tailored as needed.

- Scan printed materials into electronic format, and transferring those e-files into STARS if work is performed at CVM offices.

- Routinely transcribe, prepare, revise, and coordinate a variety of FOIA communications and reports, consulting with the FOIA Officer, Deputy, or work stream leads as necessary.
- Response letters contain all necessary elements (e.g. exemption citations, number of pages, number of pages redacted in full, appeal rights, etc.)
- Review and analyze FOIA requests and responses and makes recommendations to grant or deny records under the direction of the FOIA Officer, Deputy, or work stream lead.
- Assist the FOIA Office with ensuring maximum release of agency records, redacting only portions that are required under the Act or by other statutes. Consult with FOIA Officer as to whether CVM, and HHS policy, as well as the Act, provides a legal basis for withholding information.
- Maintain liaison with and fosters exchange of information with CVM programs to fulfill the processing of FOIA requests.
- Communicate with the requester and third parties, as needed, to refine request, negotiate alternate time periods, respond to inquiries, coordinate search, determination of the release status of records, and resolve other relevant matters.
- Send records with proprietary information, business-sensitive information, or other FOIA exemptions to the submitter (Pre-disclosure Notification) for possible objection to release under EO .
- With minimal guidance of the FOIA Officer, Deputy, or work stream lead, provide advice and assistance to CVM wide staff relative to specific FOIA requests and respond to program concerns regarding interpretation of guidelines and regulations.
- Draft official letters of denial citing specific reasons for nondisclosure and those sections of the Act and the Department regulations that provide the statutory; regulatory and policy authorities for nondisclosure. The Act imposes strict time limits for responding to requests for access to records and failure to meet those time limits may result in court actions and costly and time-consuming litigation.
